Ferguson Farms – Terms of Service

Welcome to Ferguson Farms! These Terms of Service ("Terms") govern your use of our website at https://fergusonfarms.farm ("Site") and your purchase of any goods or services offered. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
1. Definitions
"Ferguson Farms," "we," "us," or "our" refers to Ferguson Farms, LLC. "You," "your," or "customer" refers to anyone using our Site or purchasing from us. "Goods" refers to any products available for purchase on our Site. "Order" means your request to purchase goods from us. "Service" refers to our online platform and related offerings.
2. Account Registration & Customer Responsibilities
You must be at least 18 years old to place an order. You agree to provide accurate, complete, and current information when creating an account or checking out. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We are not liable for unauthorized account access caused by your failure to safeguard credentials.
3. Orders & Payment
By placing an order, you confirm you are legally authorized to use the chosen payment method. All orders are subject to acceptance and availability. All prices are listed in U.S. dollars and may change without notice prior to purchase. We accept major credit and debit cards via Stripe. Orders may be subject to fraud checks or payment verification and may be canceled at our discretion if flagged. Once your order has shipped, it cannot be canceled.
4. Subscribe & Save
Subscriptions renew automatically at your selected interval. You may pause, modify, or cancel at any time through your online account. Charges already processed are non-refundable. By subscribing, you authorize recurring billing until you cancel.
5. Shipping & Delivery
Orders ship to the address you provide at checkout. Please double-check for accuracy. Shipping fees and estimated delivery times are shown at checkout. We are not responsible for delivery issues caused by incorrect or incomplete addresses. Carrier tracking and delivery confirmation to the provided address serve as proof of delivery.
Delivery Responsibility: Once an order has shipped, we are not responsible for product condition if the customer is unavailable to receive the order, or if the delivery is delayed or rescheduled by the customer or the carrier. It is the customer’s responsibility to ensure someone is available to accept the package on the originally scheduled delivery date.
Customer Responsibilities: Because our products are perishable, you are responsible for monitoring tracking emails and ensuring prompt retrieval of your delivery. We recommend having someone available to receive the box on the expected delivery day.
Perishable Goods Disclaimer: All perishable sales are final. If your box arrives damaged, please contact us at support@fergusonfarms.farm within 24 hours of delivery and include photos of the issue.
6. Returns, Refunds & Promotions
We do not accept returns or issue refunds for perishable products that have been delivered. If you need to cancel an order, it must be done before shipping. If something doesn’t meet our quality standards, contact us within 24 hours of delivery with a description and photos. We may offer a replacement, store credit, or refund at our discretion. We do not offer refunds for personal taste preferences. For first-time customers, we recommend starting with a smaller order. Promotional codes must be applied at checkout and cannot be retroactively applied or combined with other offers unless stated.
7. Product Integrity & Storage
All products are shipped frozen or chilled with sufficient insulation and dry ice or cold packs. It is your responsibility to promptly bring your box inside upon delivery. If the contents are refrigerator-cold (under 40°F) when they arrive, they are safe to refreeze or cook immediately—just like meat purchased fresh from a grocery store. If items arrive fully warm or spoiled, do not consume them and contact us immediately.
8. Limitation of Liability
To the fullest extent allowed by law, our liability for any claim is limited to the amount you paid or $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages related to your use of our Site or products.
9. Force Majeure
We are not responsible for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, shipping carrier delays, weather events, labor disruptions, war, terrorism, or governmental actions.
10. Intellectual Property
All content on our Site—including text, images, logos, videos, and product information—is the intellectual property of Ferguson Farms and may not be used or reproduced without our written consent.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida. Any disputes will be resolved through binding arbitration in Florida unless otherwise required by law.
12. Changes to These Terms
We may update these Terms at any time. Material changes will be posted on our Site and may also be communicated by email. Continued use of our Site implies acceptance of the updated Terms.

14. Chargeback Policy
If you are unsatisfied with your order, please reach out to us before initiating a chargeback. We are committed to resolving issues quickly and fairly. Unauthorized chargebacks, especially when tracking confirms delivery, may result in account suspension. We reserve the right to dispute chargebacks and provide supporting documentation to your financial institution.
