Welcome to Ferguson Farms! These Terms of Service ("Terms") govern your use of https://fergusonfarms.farm ("our website"). By accessing, browsing, or making a purchase, you agree to be bound by these Terms. If you do not agree, please refrain from using our website.



1. Definitions
"Ferguson Farms," "we," "us," or "our" refers to Ferguson Farms, LLC.
"You," "your," or "customer" refers to any individual or entity using our website or purchasing our products.
"Goods" refers to any items offered for sale on our website.
"Orders" refers to your purchase of goods through our website.
"Service" refers to the e-commerce platform and related services provided by Ferguson Farms.

2. Account Creation & User Responsibilities
- You must provide accurate, complete, and current information when creating an account or placing an order.
- You are responsible for safeguarding your account credentials and all activities under your account.
- Ferguson Farms is not liable for unauthorized account access due to your failure to maintain security.
- Age Requirement: You must be at least 18 years old to use our website or make a purchase.

3. Orders & Payment

a. Placing Orders
- You are legally capable of entering into a binding contract.
- Your order information is accurate and complete.
- You authorize us to charge your selected payment method and represent that you are the authorized user of the payment method provided.
- You understand and agree that all sales are final except as outlined in our Returns Policy.

b. Pricing & Payment Methods

- All prices are listed in U.S. dollars and are subject to change before order acceptance.
- We accept major credit and debit cards via Stripe.
- Orders are subject to payment verification. If a transaction is declined, we may cancel your order.

c. Order Cancellation
- We reserve the right to refuse or cancel orders for reasons including but not limited to:
- Product unavailability
- Pricing errors
- Suspected fraud or unauthorized transactions

Once an order has shipped, it cannot be canceled (see Returns & Refunds below).

4. Subscriptions (Subscribe & Save)

Subscriptions automatically renew at the selected frequency unless canceled before the next billing cycle.
You can manage or cancel your subscription through your account settings.
No refunds are offered for charges already processed.
By enrolling in a subscription, you authorize Ferguson Farms to charge your selected payment method on a recurring basis until cancellation.

5. Shipping & Delivery

Orders are shipped to the address provided at checkout.
Shipping costs and estimated delivery times are displayed at checkout.
We are not responsible for incorrect addresses or failed deliveries due to inaccurate information.
Carrier tracking and delivery confirmation to the provided shipping address shall constitute proof of delivery.

Perishable Goods Disclaimer:
Due to the nature of our products, all perishable food sales are final. If an order arrives damaged, please contact support@fergusonfarms.farm within 24 hours of delivery with photos of the issue.

6. Returns, Refunds & Promotions

No Returns or Refunds on Delivered Products
Ferguson Farms does not accept returns or issue refunds for perishable products that have already been delivered. If you need to cancel an order before it has shipped, please refer to our Cancellation Policy.

7. Quality Assurance
If you receive a product that does not meet our quality standards, contact us at support@fergusonfarms.farm within 24 hours of delivery. We assess concerns on a case-by-case basis and may offer a substitution, internal credit, or refund.

Refund Discretion
Refunds are granted at the sole discretion of Ferguson Farms. Refunds will not be issued based on taste preferences, as taste is subjective. If you're trying our pasture-raised meats for the first time, we recommend ordering a smaller quantity before placing a larger order.

Promotions & Discounts
Promotional codes must be applied at checkout and cannot be retroactively applied. Ferguson Farms reserves the right to modify, extend, or cancel promotions at any time.

8. Limitation of Liability
To the fullest extent permitted by law:
Our liability is limited to the amount you paid for your order or $100, whichever is higher.
We are not liable for indirect, incidental, or consequential damages arising from your use of our website or products.

9. Intellectual Property
All content on our website, including text, images, logos, and product descriptions, is the exclusive property of Ferguson Farms. Unauthorized use, reproduction, or distribution is prohibited.

10. Governing Law & Dispute Resolution
These Terms are governed by the laws of Florida, United States. Any disputes shall be resolved through binding arbitration in Florida, unless otherwise required by law.

11. Changes to These Terms
We may update these terms at any time. Material changes will be posted on our website and, where appropriate, notified via email. Your continued use of our website constitutes acceptance of the revised Terms.

13. Chargeback Policy
Before initiating a chargeback or payment dispute, you agree to contact Ferguson Farms at support@fergusonfarms.farm to attempt a good-faith resolution.
Unauthorized chargebacks, particularly when products were delivered or services rendered as described, may result in account termination and restriction of future service.
We reserve the right to dispute any chargeback and provide transaction records, tracking information, and all applicable terms accepted at checkout as evidence to your financial institution.
